Welcome to LandlordForms. These Terms and Conditions ("Terms") govern your access to and use of our web application, services, and related content (collectively, the "Service"). By accessing or using LandlordForms, you agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through a prominent notice on our Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Eligibility

To use LandlordForms, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

By creating an account, you represent and warrant that you meet all eligibility requirements.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password and account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring you log out at the end of each session

We are not liable for any loss or damage arising from your failure to maintain account security.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, suspected fraudulent activity, or any other reason at our sole discretion. You may delete your account at any time through the account settings page.

4. Service Description

LandlordForms provides landlords and property managers with tools to:

  • Generate legal notices (rent increases, violations, terminations, etc.)
  • Track rent payments and maintain digital rent ledgers
  • Manage property and tenant information
  • Document property inspections with photos
  • Generate payment receipts and reports

Important Notice: LandlordForms provides tools and templates only. We do not provide legal advice. The notices and documents generated through our Service are templates based on common practices and may not be suitable for your specific situation or compliant with all local laws and regulations.

YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT ANY DOCUMENTS YOU GENERATE COMPLY WITH APPLICABLE FEDERAL, STATE, AND LOCAL LAWS. WE STRONGLY RECOMMEND CONSULTING WITH A QUALIFIED ATTORNEY BEFORE SERVING ANY LEGAL NOTICES OR TAKING ANY LEGAL ACTION.

5. Subscription Plans and Payments

5.1 Free and Paid Plans

LandlordForms offers both free (Starter) and paid subscription plans (Professional, Business). Plan features, pricing, and limitations are described on our pricing page and may change at any time with reasonable notice.

5.2 Billing and Payment

By purchasing a paid subscription, you agree to:

  • Pay all fees and charges associated with your subscription
  • Provide current, complete, and accurate payment information
  • Update payment information promptly if it changes
  • Authorize recurring charges to your payment method

All payments are processed securely through Stripe. We do not store your credit card information on our servers.

5.3 Subscription Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged the then-current subscription fee unless you cancel.

5.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. You will retain access to paid features until the end of your billing period.

Refund Policy: We offer a 30-day money-back guarantee for annual subscriptions. Monthly subscriptions are non-refundable after the first billing cycle. To request a refund, contact us at support@landlordforms.io within the eligible refund period.

5.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply upon renewal. We will provide at least 30 days' notice of any price increases.

6. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any applicable federal, state, local, or international law or regulation
  • Infringe upon or violate our intellectual property rights or those of others
  • Harass, threaten, defame, or discriminate against any person or group
  • Transmit any viruses, malware, or malicious code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or store personal data about other users without consent
  • Use the Service for any illegal, fraudulent, or unauthorized purpose
  • Resell, sublicense, or redistribute the Service without authorization
  • Reverse engineer, decompile, or disassemble any part of the Service

Violations of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service, including all content, features, functionality, software, text, graphics, logos, and trademarks, is owned by LandlordForms and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

7.2 Your Content

You retain all ownership rights to the content you create, upload, or input into the Service ("Your Content"), including property data, tenant information, notices, and documents. By using our Service, you grant us a limited, non-exclusive, royalty-free license to host, store, and process Your Content solely for the purpose of providing the Service to you.

7.3 Generated Documents

Documents you generate using our templates belong to you. However, you acknowledge that the underlying templates and software are our intellectual property and remain subject to these Terms.

8. User Responsibilities

As a user of LandlordForms, you are responsible for:

  • Data Accuracy: Ensuring all information you enter is accurate, complete, and up-to-date
  • Legal Compliance: Complying with all applicable landlord-tenant laws, fair housing regulations, and local ordinances
  • Document Review: Carefully reviewing all generated documents before use and consulting legal counsel when appropriate
  • Proper Service: Following proper legal procedures for serving notices and documents
  • Privacy: Protecting the privacy and confidentiality of tenant information
  • Backup: Maintaining your own backups of important data (we provide backups but recommend you maintain copies as well)
  • Security: Using strong passwords and keeping your account secure

9. Disclaimers and Limitations

9.1 No Legal Advice

LANDLORDFORMS IS NOT A LAW FIRM AND DOES NOT PROVIDE LEGAL ADVICE. The information, templates, and tools provided through our Service are for informational purposes only and should not be construed as legal advice. You should consult with a qualified attorney regarding your specific situation and legal obligations.

9.2 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • The quality of any documents or information obtained through the Service will meet your expectations
  • Any errors in the Service will be corrected

9.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LANDLORDFORMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your access to, use of, or inability to use the Service
  • Any conduct or content of any third party on the Service
  • Unauthorized access, use, or alteration of your content or data
  • Errors, inaccuracies, or omissions in any content or documents
  • Legal disputes, judgments, or damages arising from documents generated through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9.4 Indemnification

You agree to indemnify, defend, and hold harmless LandlordForms, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any documents or actions you create or take using the Service.

10. Third-Party Services

Our Service integrates with third-party services including Stripe (payment processing), Mailgun (email delivery), Tawk.to (customer support), and Sentry (error tracking). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices, content, or services of these third parties.

11. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

You are responsible for ensuring that any tenant or personal data you input into the Service complies with applicable privacy laws, including obtaining necessary consents and providing required notices.

12. Dispute Resolution

12.1 Informal Resolution

If you have any dispute with us, you agree to first contact us at legal@landlordforms.io to attempt to resolve the dispute informally. We will work in good faith to resolve the issue.

12.2 Arbitration Agreement

If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration conducted in English in The Hague, the Netherlands, in accordance with the International Chamber of Commerce (ICC) Arbitration Rules.

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

12.3 Exceptions

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or confidential information.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts of The Hague, the Netherlands, and you hereby consent to personal jurisdiction and venue therein.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and LandlordForms regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

16. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or our rights and obligations at any time without notice or consent. Any attempted assignment in violation of this provision is void.

17. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
