What Your Entry Notice Must Include
Miss any of these and your entry may be considered illegal. Tenants can sue for invasion of privacy.
- Property address — Full address including unit number
- Date and time of entry — Specific time, during reasonable hours
- Purpose of entry — Repairs, inspection, showing, etc.
- Who will enter — Landlord, contractor, inspector
- Landlord contact info — Phone number for questions
Important: Keep a copy of every entry notice with delivery proof. If the tenant claims you entered illegally, you have documentation.
5 Mistakes That Violate Tenant Privacy
Not enough advance notice
California requires 24 hours. Florida requires 12. Knock on the door 1 hour beforehand? Illegal entry. Check your state law.
Unreasonable hours
8am-6pm is generally acceptable. Showing up at 7am or 9pm violates reasonable hour requirements in most states.
Vague purpose
"Stopping by to check on things" isn't a valid reason. You need a specific purpose: repairs, inspection, showing to buyer.
Verbal notice only
Telling them in passing or by text may not count. Many states require written notice. Put it in writing and keep a copy.
Too many entries
Even with proper notice, excessive entries can be harassment. You own the property but the tenant has right to quiet enjoyment.

Frequently Asked Questions
How much notice do I need to give?
It varies by state. California: 24 hours. Florida: 12 hours. Texas: no specific requirement but reasonable notice (24 hours) is recommended. Check your state law.
Can I enter for emergencies without notice?
Yes. Fire, flooding, gas leaks, and other emergencies allow immediate entry. You don't need notice when there's immediate danger to life or property.
What are "reasonable hours"?
Generally 8am to 6pm on weekdays, and 9am to 5pm on weekends. Some states specify this in law. When in doubt, stick to normal business hours.
Can the tenant refuse entry?
If you've given proper notice for a valid reason, no. Repeated refusal is a lease violation. But don't force entry — document the refusal and address it legally.
Do I need notice to show the property?
Yes. Showing to prospective tenants or buyers requires advance notice just like any other entry. The property is still their home.
How should I deliver the notice?
Post it on the door, hand deliver, or send by mail. Keep proof of delivery. Some landlords take a timestamped photo of the notice on the door.
