- How many days do I have to return the deposit?
- Maryland requires the deposit back within 45 days of the tenancy ending. Missing that deadline can cost you the right to withhold anything at all, and several states add penalty damages on top of the deposit itself.
- What can I deduct from the deposit?
- Unpaid rent, and damage beyond normal wear and tear. Not ordinary ageing: faded paint, worn carpet and small nail holes are wear and tear almost everywhere. Cleaning is deductible only to bring the unit back to its move-in condition, not to improve it.
- Do I need receipts for deductions?
- Send an itemised statement, and keep a receipt or written estimate behind every line of it. Maryland gives you 45 days. A deduction with a number but no supporting document is the one a tenant successfully challenges.
- What if the deductions exceed the deposit?
- Send the itemised statement showing the deposit fully applied, then bill the balance separately. The deposit cap in MD is 2 months, so a serious loss will often exceed it. Collecting the excess means making a claim, usually in small claims court.
