- How many days late before I can charge a fee?
- Whatever the lease says, subject to any grace period Delaware requires. If the lease is silent on late fees, you generally cannot charge one at all. Write the grace period and the fee into the lease before you need them.
- What is a reasonable late fee?
- Courts generally look for a fee that reflects your actual cost, commonly a small percentage of monthly rent. A fee large enough to read as a penalty rather than a cost is the one that gets struck down. Check whether Delaware caps it before setting yours.
- Can I evict for late rent?
- Yes, but not with a late rent notice. In Delaware you serve a 5-day pay-or-quit notice first, and file with the court only if the tenant neither pays nor leaves within that window.
- Should I accept partial payment?
- Understand the tradeoff first. Accepting partial payment can reset or invalidate a pending pay-or-quit notice in many states. If you have already served notice, take partial payment only alongside a written agreement saying the notice still stands.
